1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the website located at mindgamebaseball.com and all related registration, scheduling, booking, and payment functionality (collectively, the "Services"), operated by Mind Game Baseball Academy ("MGBA," "we," "us," or "our").
By creating an account, registering a player, applying as a coach, booking a lesson, registering for a camp, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. Our Privacy Policy describes, among other things, our commitment never to sell, rent, or distribute your information or your player's information beyond the scope of operating MGBA's programs. If you do not agree to these Terms or the Privacy Policy, you may not use the Services.
If you are registering or creating an account on behalf of a minor child, you represent that you are the child's parent or legal guardian and have full authority to agree to these Terms, including the assumption of risk and liability waiver in Section 9, on the child's behalf. As described further in Section 3 below, the child does not separately access or use the Services; only the parent or legal guardian, as Account Holder, does so.
2. Description of Services
MGBA provides youth and amateur baseball development programming in the Central Savannah River Area (CSRA), including:
- Individual, one-on-one baseball lessons booked through MGBA-approved coaches
- Periodic group development camps
- A community baseball league for 12U and 14U divisions (launching 2027)
- A developmental travel team for select age divisions
- Related online account, scheduling, and payment functionality
MGBA acts as a platform connecting players and families with MGBA-approved independent coaches for individual lessons. MGBA directly operates the community league, camps, and travel team programming described above.
3. Eligibility and Accounts
- Only a parent, legal guardian, the Academy Director, an MGBA-approved coach, or a player who is 18 years of age or older may create an account and hold login credentials. Players — unless over the age of 18 — do not independently create accounts, hold login credentials, or otherwise directly access the Services as a player. A minor player's information is entered into the Services solely by the parent or legal guardian acting as the registered Account Holder; players who are 18 years of age or older may create their own account and enter their own information.
- Account Holders (parents, legal guardians, coaches, and the Academy Director) must be at least 18 years old.
- You agree to provide accurate, current, and complete information during registration and to update such information as needed.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- A single parent/guardian account may include multiple linked player profiles for siblings or multiple children within the same household.
- MGBA reserves the right to suspend or terminate any account that provides false information, violates these Terms, or poses a risk to the safety or integrity of the Services.
4. Lesson Bookings
- Lessons are booked through the online scheduling system at a rate set by the individual coach for the relevant age group and session duration (30, 45, or 60 minutes)
- Full payment is collected at the time of booking through Stripe. A processing fee is added to the coach's listed rate and disclosed prior to checkout
- Coaches set and may update their own availability, including blocking specific dates or date ranges for vacations or other unavailability, and may temporarily pause new bookings altogether. MGBA does not guarantee that a specific coach will be available at any given time.
- Cancellation, refund, and reschedule policies for lesson bookings will be published separately prior to launch.
5. Camps, League, and Travel Team Registration
- Camp registration is subject to availability and may be limited by age group or session capacity
- Community league registration for the 12U and 14U divisions is governed by additional league-specific rules, schedules, and fee terms to be published separately prior to the 2027 season launch
- Travel team participation is by tryout and coach evaluation. Roster placement is at MGBA's sole discretion and is not guaranteed by registration or payment of any interest deposit.
- League and travel team refund and withdrawal policies will be published separately prior to launch.
6. Payments and Fees
- All payments are processed by Stripe, Inc. By making a payment through the Services, you agree to Stripe's terms of service (stripe.com/legal).
- MGBA does not store full payment card information.
- Coaches who offer paid lessons must complete Stripe Connect onboarding, including identity verification and bank account information provided directly to Stripe, to receive payouts.
- MGBA retains a platform fee from each lesson transaction, in addition to the Stripe processing fee, before remitting the coach's portion to the coach's connected Stripe account.
- All fees are in U.S. dollars. You are responsible for any fees charged by your bank or card issuer.
7. Coach Relationship; Independent Contractor Status
- Coaches who provide individual lessons through the Services do so as independent contractors. Nothing in these Terms creates an employment, agency, joint venture, or partnership relationship between MGBA and the coach.
- MGBA reviews coach applications and may require a background check prior to approving a coach. Approval reflects MGBA's assessment at the time and is not a guarantee of a coach's conduct or performance.
- Coaches are solely responsible for the manner and means by which they deliver lessons, subject to MGBA's published professional standards. Coaches are responsible for their own tax reporting.
- MGBA may decline to approve, suspend, or remove a coach at its sole discretion.
8. Code of Conduct
All users — players' parents/guardians and coaches — agree to:
- Treat all coaches, players, parents, umpires, and MGBA staff with respect
- Refrain from harassment, abuse, or discriminatory conduct
- Comply with all facility rules at any location where MGBA programming takes place
- Provide accurate information regarding a player's age, division eligibility, and relevant medical or physical considerations
- Refrain from any conduct that endangers the safety of any participant
MGBA reserves the right to remove any individual from a program, without refund, for violation of this Code of Conduct.
9. Assumption of Risk and Liability Waiver
Participation in baseball-related activities, including individual lessons, camps, practices, games, and tournaments, carries inherent risks of physical injury, including but not limited to being struck by a thrown or batted ball, collision with other players, sprains, strains, fractures, and in rare cases, more severe injury.
- Assumption of Risk. By registering a player for any MGBA program, you acknowledge and voluntarily assume all risks of injury associated with participation in baseball-related activities, whether arising from the negligence of MGBA, its coaches, other participants, or otherwise, to the fullest extent permitted by applicable law.
- Release of Liability.To the fullest extent permitted by applicable law, you, on behalf of yourself and the minor player you are registering, release, waive, and discharge MGBA, its Academy Director, employees, and MGBA-approved independent contractor coaches from any and all liability, claims, demands, or causes of action arising out of or related to any injury, loss, or damage that may occur as a result of the player's participation in MGBA programming, except to the extent such claim arises from gross negligence or willful misconduct.
- Medical Treatment Authorization. In the event of an injury during an MGBA program where a parent or guardian cannot immediately be reached, you authorize MGBA staff or the supervising coach to secure appropriate emergency medical treatment for the player, with the understanding that the parent or guardian remains financially responsible for any costs of treatment.
- No Warranty of Safety. While MGBA and its coaches take reasonable precautions, MGBA does not warrant or guarantee that any facility, equipment, or activity is free from risk of injury.
10. Background Checks
Prospective coaches consent to MGBA conducting, or engaging a third-party consumer reporting agency to conduct, a background check as a condition of approval to provide lessons or coach within MGBA programming. FCRA disclosure language will be added once a background check vendor is selected.
11. Intellectual Property
All content on the Services, including text, graphics, logos, the MGBA name and brand, and the underlying software, is owned by MGBA or its licensors. You may not copy, reproduce, distribute, or create derivative works from the Services without MGBA's prior written consent.
By submitting a photograph, testimonial, or similar content to MGBA, you grant MGBA a non-exclusive, royalty-free license to use that content in connection with operating and promoting the Services, unless you specifically opt out in writing.
12. Dispute Resolution; Governing Law
These Terms shall be governed by the laws of the State of South Carolina, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state or federal courts located in Aiken County, South Carolina.
13. Termination
You may close your account at any time by contacting hello@mindgamebaseball.com. MGBA may suspend or terminate your access to the Services at any time for conduct that violates these Terms. Sections that by their nature should survive termination — including the liability waiver in Section 9, intellectual property in Section 11, and dispute resolution in Section 12 — will survive.

MGBA may revise these Terms from time to time. If we make material changes, we will provide notice through the Services or by email prior to the changes taking effect.
